He recently obtained US patent protection on Medennium’s photochromic intraocular lenses, which is one of the company’s biggest commercial products. In addition, partner Andrew Ulmer, who is described by one peer to be “one of the best and brightest patent attorneys,” prepared and managed the preparation of 60 new patent applications for a Johnson & Johnson subsidiary. Goodwin Procter “They have a really impressive life sciences industry group, but I think it really starts with their IP group,” argues one attorney about Goodwin Procter. The Boston-based firm has the technological expertise to take advantage of its location in an innovator-driven hub. Another rival of the firm believes, “They have a great marriage between their IP practice and their financial and transactional specialists that allows them to really understand any client’s business needs.” Goodwin represents a large number of clients including Esperion Pharmaceuticals and Avila Pharmaceuticals on IP-business related matters. A great example of the IP and business law practices working together is the firm’s representation of underwriters in Intercept Pharmaceuticals initial public offering. IP partner Duncan Greenhalgh, who a competitor sees as, “an extremely valuable asset to the Goodwin team,” assisted with the procurement of certain patent rights essential to the deal. He also worked on Abbott Laboratories purchase of rights to develop and commercialize a kidney drug compound from Goodwin’s client Action Pharma. Though the firm represents both branded and generic companies in Hatch-Waxman litigation disputes, they have gained a lot of notoriety for their work on the generic side. “He is really among the best in the country dealing with generics,” says one practitioner about partner David Hashmall. Along with partner Daryl Wiesen, Hashmall represented Teva Pharmaceuticals in a patent infringement suit against Synthon Pharmaceuticals. Greenberg Traurig The life sciences patent litigation team at Greenberg Traurig is gaining more recognition from their counterparts in the industry. ‘They already have two standout litigators in Richard Pettus and Scott Bornstein, but you can see that they have a pipeline of talented attorneys who are gaining valuable experience working with Richard and Scott.” The firm represents a large variety of clients including Boston College, General Mills, and Teva Women’s Health. Bornstein co-chairs of the firm’s global patent litigation practice and helps coordinate litigations both domestically and internationally. One of his colleagues views him as, “a great in-court talent and also a great teacher.” Bornstein recently represented Enzo Biochem in a patent action involving multiple defendants over labeled nucleotide products. Bornstein also advised medical device manufacturer Delcath Systems in regards to balloon catheters used to isolate specific organs for the purpose of supplying concentrated doses of chemotherapy agents.
