INSTITUTIONAL / LEGAL FRAMEWORK ANALYSIS
The institutional / legal framework of the AAA is composed of a set of formal and informal relationships . The main actors of this framework are basically NUCA , CA , Mall Managers and / or Occupants Unions , Shopkeepers and Owners , and Street Vendors . Both formal and informal rules guide the relationship between the previously mentioned stakeholders . In order to understand this institutional / legal setting , a list of the formal laws , by-laws and regulations associated with the area and the type of commercial activities that exist in it will be mentioned . These laws and regulations are not all activated within the AAA , yet should act as a guide for any future interventions associated with the area .
2.5.1 LAWS , BYLAWS AND REGU- LATIONS
The unified building law declares the duties of the local authorities in monitoring the regulations related to the new cities , and what should be provided by the detailed plan of the commercial areas . It also declares the regulations related to the Occupants ’ Unions .
The unified building law no 119 / 2008 On The Regulation of Resident Union
• Article 155 :
Head of the administrative body shall identify the headquarters of the resident union department , personnel thereat and their responsibilities and duties . Such decision shall be affixed in the notice board at the administrative body headquarters .
The resident union department shall survey the properties and residential groups within the scope of the administrative body that need a resident union , pursuant to Article ( 72 ) of the Law and survey the existing owners ’ association for adjustment .
The department shall-during three months of the issuance of the regulations and system of resident union-advise property occupants on which the provisions of chapter one ( Part four ) of the law apply , who have no union , to establish a resident union or adjust the current owners ’ association , via a return-receipt requested mail , placing a copy of the notice in a clear place at the property .
The union head shall register the union at the appropriate department , within 45 days of the expiry of the aforesaid period . Thereafter , the union shall have a judicial personality , effective from its registration .
• Article 156 :
Occupants of properties shall form a resident union , in accordance with the system of the competent minister .
A resident union covering more than one property or a group of adjacent properties may be formed , if the total number of units of such properties exceeds five units .
• Article 157 :
Voting rate and contribution in the financial obligations defined by the general meeting shall be based on the ratio of surface area of the unit share in land to the total surface area of the land . However , the square meter of the commercial and administrative structures shall be double the square meter of the residential structures in computation .
