How to buy a residential property ?
Off-plan sale
Off-plan sale is a type of real estate transaction . It occurs when a buyer acquires a property before it is built . These properties are sold by real estate developers .
Sometimes , the sale is regulated by a “ Vente en l ’ état futur d ’ achèvement ” ( VEFA ): According to Article 1601-3 of the Civil Code , “ VEFA is the contract by which the seller immediately transfers his rights to the land , as well as ownership of existing constructions to the buyer . As they are carried out , the future works come under the responsibility of the buyer , who is then required to pay the price as the work progresses . The seller retains the powers of the project owner until the work is completed .”
In the case of a VEFA , the developer must obtain a “ Garantie financière d ’ achèvement ” ( GFA ), which gives the buyer the assurance that in case the developer fails to pay , the financing of the building is still guaranteed . The GFA is executed in two distinct modes : the intrinsic mode , in which the developer itself guarantees the completion of the real estate project , and the extrinsic mode , in which an external guarantor , such as a bank , provides this guarantee .
