Penalties
When the Minister has reasonable grounds to believe that a veterinarian has been found guilty in a court of law of a
designated drug offence, a contravention of these regulations or a contravention of a provision of these regulations, the
Minister shall report this information to the provincial licensing authority. A notification may result in an investigation for
potential professional misconduct.
For serious situations (e.g., diversion), the Department of Justice may pursue legal action. Any person who
contravenes any of the provisions of the Act or of its regulations is guilty of an offence. If found guilty of an offence, the
penalties are as follows:
• A person found guilty of an indictable offence is liable to a fine not exceeding $5,000 or imprisonment for a term not
exceeding 3 years or to both;
• Under the Controlled Drugs and Targeted Substances Act, a person found guilty on summary conviction is liable to
a fine not exceeding $1,000 or imprisonment for a term not exceeding 6 months or both;
• Under the Food and Drugs Act, a person found guilty on summary conviction for a first offence is liable to a fine not
exceeding $500 or to imprisonment for a term not exceeding 3 months or both and for a subsequent offence a fine
not exceeding $1,000 or imprisonment for a term not exceeding 6 months or both.
