Appellate Practice Section Chairs : BrandonK . Breslow — Kynes , Markman & Felman , P . A . & DavidM . Costello — FloridaSolicitorGeneral ’ sOffice

We hope you are sitting down for this . The sun has set on Joe Eagleton and Chance Lyman ’ s time as co-chairs of the Appellate Practice section . Joe and Chance were at the helm together for three years , where they smoothly navigated our members through an unprecedented pandemic and significant changes to the Florida rules of Appellate Procedure ( we ’ re looking at you , Bookman old style ). You may see Joe and Chance in Aloha shirts on st . Pete Beach enjoying their well-deserved rest and recuperation , but the more likely plan is that they are putting their new Board Certification accolades to good use .

We are honored to have this opportunity to introduce ourselves as your new co-chairs and to preview the year ahead . David M . Costello is a Deputy solicitor general for the state of Florida , an adjunct professor of Appellate Advocacy at stetson University College of Law , and a former law clerk to United states Circuit Judge
Charles r . Wilson ( CA11 ) and United states District Judge robert L . Hinkle ( FLnD ). Brandon K . Breslow is an appellate practitioner at Kynes , Markman & Felman , P . A ., a Vice Chair for The Florida Bar Federal Court Practice Committee , and a former law clerk to United states Magistrate Judge gary r . Jones ( FLnD ). David enjoys trying ( and failing ) to hit a golf ball straight . Brandon has a love / hate relationship with distance running . There is no doubt that the section will continue to witness considerable changes to Florida ’ s appellate landscape — a new Florida supreme Court justice , a new Eleventh Circuit judge , and a new Florida appellate court . In fact , plans for the sixth District Court of Appeal are well under way . The Florida supreme Court has formed the “ Workgroup on the Implementation of an Additional District Court of Appeal ” to identify and manage

critical operational activities in advance of the sixth DCA ’ s effective date of January 1 , 2023 . We will learn soon how the boundary changes will impact cases in the second DCA that are pending at the end of this year . While it is anybody ’ s guess how the next year will turn out , we are excited to plan programming for the section that will benefit members and foster a continued dialogue about the improvement of our profession . Topics like technology and jurisdiction are top of mind , but we want to hear from you . The Appellate Practice section aims to provide its members with opportunities to get involved with programming , publications , and pro bono . To that end , we are here to serve you this year and ( hopefully ) for more to come . n
