E & O TIPS AND WHAT TO WATCH FOR If an insured contacts you and spouts terminology only a lawyer would use , they ’ ve likely been talking to one . Be on the listen for words and phrases like :
• Bad faith
• Breach
• Duty
• Breach of Duty way to answer that make you look good ):
• Could you have found pandemic coverage for me ?
• Why didn ’ t you get me the coverage I needed ?
• Why didn ’ t you know this wouldn ’ t be covered ? And , of course , the unambiguous threat :
• “ I ’ m calling my lawyer .”
• “ I ’ m going to sue you .”
If you get any indication that makes you think you might get sued , notify your E & O carrier immediately . Let them begin building a file and advising you through the process .
