that have to be taught without reducing time, because they are the
basic ones. I don’t even talk about ethics and deontological issues, but
in technical terms, they have to know exactly what they are going to
do, and they need to have the necessary and appropriate instruments to
deal with situations that they will have to face.
JT: Magistrates (judges and prosecutors) are traditionally
perceived as a conservative class, not very keen on using new
technological means. CEJ has focused on new technologies to
support distance learning and training.
How have magistrates been reacting to the use of these new
technologies?
EL: This is an urban myth. Portugal has been, for
many years, ahead of most of its neighbour countries.
The courts operate on the basis of a software – which might not be
one of the most technically developed, but it is a program that was
built by Portuguese judicial officials – “Citius”, it is called. The whole
system is based on it, that is, everything is digitized – all processes
are digital. Lawyers can only file petitions or contestations digitally.
All of this is already implemented and working – with its faults, with
its problems – but it works.

Considering the use of new technologies, even the courts
use it... Not only do they use it, but they have to. Portugal
was also one of the countries that first implemented witness
inquiry by videoconference; we are not bad at this level.
Therefore, since the beginning of the training that the future
judges receive – auditors of Justice – here in the CEJ, they are
familiarized to work with Citius and they receive a computer
with the program installed in order to learn how to use it...
Although we have scarce means, they are enough to put us
at the forefront of the most developed countries in Europe.
At the level of the initial training, we use the Moodle platform. We
use it internally, so that we can make available practically all the
materials for the auditors of Justice, with great ease of interaction.
Also at the level of continuous training, the use of either Moodle, or
of video conferencing or of streaming with many reception points –
where judges and prosecutors from all over the country join the courts
– allows an important interaction with the trainees.
It is also true that we have come to the conclusion, that although
there is a lot of video–streaming broadcasting in the courts – and,

JT: Los magistrados (jueces y procuradores) son
tradicionalmente vistos como clases conversadoras. El CEJ
apuesta en nuevas tecnologías de soporte para el aprendizaje
y la formación a distancia.
¿Cómo ha sido la aceptación por parte de los Magistrados de
estas nuevas tecnologías?
EL: Portugal es, desde hace muchos años, uno de los países
más adelantados con respecto a la situación de algunos paises
vecinos. Los tribunales funcionan con la base de un programa
informático – que no es el más desarrollado en términos
técnicos – pero es un programa (el Citius) que fue construido por
portugueses, por funcionarios judiciales y que es la base sobre
la cual se asienta todo el sistema, o sea, todo está digitalizado,
todos los procesos son digitales. Los abogados solo pueden
introducir peticiones iniciales y contestaciones por vía digital.
Todo esto está ya implementado y funcionando – con sus defectos
y sus problemas – pero funciona. ..
El inicio de la utilización de medios

Al nivel de la utilización de las nuevas tecnologías, es
cierto que los tribunales las utilizan, y no solo eso, sino que
tienen que usarlas. Portugal fue también uno de los países
que más tempranamente implementó la rigurosidad en las
presencias por videoconferencia. No estamos mal en ese nivel.
Por tanto, desde el inicio de la formación que los futuros
jueces – auditores de justicia – aquí en el CEJ se habitúan
a trabajar con el programa Citius, recibiendo un ordenador
con el programa instalado para que se puedan adaptar.
Aunque los medios sean pocos, son los suficientes para
situarnos al frente de los países más desarrollados en Europa.
A nivel de formación inicial, utilizamos la plataforma Moodle
que permite poner a disposición de los auditores de justicia
los materiales con una mayor facilidad de interacción. Pero
también al nivel de la formación continua, la utilización del
Moodle, las transmisiones por videoconferencia o mediante
streaming, con muchos puntos de recepción – donde se unen
los jueces y fiscales a lo largo del país, en los tribunales,
lo que permite una mayor interacción con los formandos.
También es verdad que llegamos a la conclusión de que, a pesar
de haber mucha transmisión por videoconferencia a través
de streaming para los tribunales – llegando así a más gente – si
eso no fuera complementado con algunas acciones de formación
