Dominican Republic: an example of penitentiary reform to be followed

I
n the Dominican Republic, two prison systems coexist: the
traditional one –managed by police and forces of the military
body –and that of the new model (civilian body specialized in
treatment, management and prison security).
The New Penitentiary Management Model entails a shift in the
paradigm of the treatment of prisoners, which takes into account
their fundamental citizenship rights, even though they are in conflict
with law and criminal justice. With the foundation of the National
Penitentiary School since July 30th, 2003, the formation of Prison
Surveillance and Treatment Agents (VTPs), of professionals and
technicians, enabled the opening, in 2004, of the first Correction
and Rehabilitation Center (CCR), initiating the operation of the
great New Model of Penitentiary Management of the Dominican
Republic.
After one year of intensive training, the VTP agents are incorporated
into the staff that are already performing functions at the Correction
and Rehabilitation Centers (CCRs). Thus, there is a distinction not
only conceptual, but also terminological, between the old system
and the new, since in the first one speaks of prisons and guards,
whilst in the second there are correction and rehabilitation centers,
surveillance and treatment personnel.
Presently, the Dominican penitentiary reform is intended to cover an
increasing proportion of the system, through political will, external
recognition and also the affirmation as an optimal penitentiary
model for neighboring countries.
JT: What are the differences between the new penitentiary
model and the traditional model?
YP: The differences are abysmal. The traditional system does not
have the created conditions, nor the adequately trained staff, or
the management model to guarantee and respect the fundamental
rights and the dignity of the prisoners. In the traditional system, a
culture founded in vengeful justice reigns, which is plagued with bad
practices, which make the system inoperative turning the fulfilling
of the prison sentence into a true hell. The various claims against
the system of vexations, extortions and existing corruption against
the recluse population make the dismantlement of the militaristic
and police–centered view of the penitentiary system imperative.
The Dominican penitentiary system has forty–one (41) facilities, of
which twenty–two (22) belong to the New Model of Penitentiary
Management, in which the Vigilance and Penitentiary Treatment
Agents are responsible for the security, and the Police and National

El Nuevo Modelo de Gestión Penitenciaria constituye una mudanza
de paradigma del tratamiento de los privados de libertad, en el
cual se tienen en cuenta sus derechos ciudadanos fundamentales,
a pesar de que estén en conflicto con la ley y la justicia penal.
Con la fundación de la Escuela Nacional Penitenciaria desde
el 30 de julio de 2003, la formación de Agentes de Vigilancia y
Tratamiento Penitenciario (VTPs), de profesionales y técnicos,
permitieron viabilizar la apertura, en el año 2004, del primer Centro
de Corrección y Rehabilitación (CCR), iniciando el funcionamiento
del gran Nuevo Modelo de Gestión Penitenciaria de la República
Dominicana.
Tras un año de formación intensiva, los Agentes VTPs se incorporan
al personal que desarrolla funciones en los Centros de Corrección
y Rehabilitación (CCRs). Así, existe toda una distinción no solo
conceptual, sino también terminológica, entre el viejo sistema y el
nuevo, ya que en el primero se habla de cárceles (o prisiones) y de
guardias, mientras que en el segundo existen centros de corrección
y rehabilitación y personal de vigilancia y tratamiento.
Actualmente, la reforma penitenciaria dominicana se encamina a
abarcar cada vez más proporción del sistema, a través de la voluntad
política, del reconocimiento externo y también de la afirmación
en cuanto a modelo penitenciario óptimo para los países vecinos.
JT: ¿Qué diferencias hay entre el nuevo modelo penitenciario
y el tradicional?
YP: Las diferencias son abismales. En el sistema tradicional no
están las condiciones creadas, ni el personal está debidamente
formado, ni están las líneas de trabajo, ni tampoco está el modelo de
gestión para garantizar, respetar los derechos fundamentales y la
dignidad de las personas privadas de libertad. En la administración
tradicional impera una cultura fundamentada en la justicia
vengativa, plagada de malas prácticas, que hacen que el sistema
sea inoperante, convirtiendo el cumplimiento de la pena privativa
de libertad en un auténtico infierno. Las diversas denuncias sobre
el sistema de vejaciones, extorsiones y corrupción existente contra
la población recluida, hace imperativo el desmontaje de la visión
militarista y policiaca del sistema penitenciario.
El sistema penitenciario dominicano cuenta con cuarenta y un
