THE ROLE OF UNODC IN PENITENTIARY REFORM PROCESSES IN LATIN AMERICA

The model of deprivation of liberty in Latin America has been going through a deep crisis for decades , and penitentiaries have shown their endemic weakness in order to fulfil the purposes of the sentence . Preventive detention and imprisonment as punishment are the main measures and sanctions used against people accused or convicted in criminal proceedings . This has led to the excessive use of custodial sentences that portrays the penitentiary systems of the region , and it has consequences which involve the violation of the human rights of prisoners , and the inability to respond adequately to the need for social reintegration .
Prisons are areas of violence and corruption , where the systematic violation of human rights prevails , characterized by overcrowding , which in itself constitutes one of the main violations of the rights of people deprived of their liberty , and also of the prison staff . Within the United Nations System , UNODC is well placed to help Member States in coping with the global prison crisis , especially by supporting prison reform initiatives always in line with human rights .
UNODC not only promotes the application of international standards and rules when it comes to crime prevention and criminal justice 1 , but it also acts as a “ secretary ” for intergovernmental processes initiated to write or to revise those standards 2 . In addition to international standards concerning the care of people deprived of their liberty and administration of prisons ( such as the Nelson Mandela Rules and the Bangkok Rules ), UNODC has a series of Handbooks on Criminal Justice and other relevant publications related to prison reforms , such as HIV / AIDS prevention and care and treatment of people deprived of their liberty ( including groups in special situations of vulnerability ) 3 Taking into account the different factors contributing to the prison crisis , UNODC focuses mainly on the three following strategic objectives : reducing the use of imprisonment , improving conditions of detention and , finally , supporting social reintegration programs for people deprived of their liberty after their release .
El modelo de privación de libertad en América Latina atraviesa hace décadas una profunda crisis y los centros penitenciarios han mostrado su endémica debilidad para dar cumplimiento a los fines de la pena . La detención preventiva y el encarcelamiento como pena , son las principales medidas y sanciones utilizadas contra las personas acusadas o condenadas en el proceso penal y esto ha provocado que el uso excesivo de la pena privativa de libertad caracterice a los sistemas penitenciarios de la región con consecuencias que suponen la vulneración de los derechos humanos de las personas encarceladas y la imposibilidad de responder adecuadamente a las necesidades de reintegración social .
Las cárceles son espacios de violencia , corrupción y violación sistemática de los derechos humanos , caracterizadas por el hacinamiento , hecho que en sí mismo constituye una de las principales violaciones a los derechos de las personas privadas de libertad y del personal penitenciario . Dentro del Sistema de Naciones Unidas , UNODC se encuentra en una adecuada posición para asistir a los Estados Miembros para hacer frente a la crisis penitenciaria global , brindando apoyo a iniciativas de reforma penitenciaria en línea con los derechos humanos .
UNODC promueve la aplicación de estándares y normas internacionales en materia de prevención del delito y justicia penal 1 y actúa como Secretaría para los procesos intergubernamentales iniciados para redactar o revisar esas normas 2 . Adicional a los estándares internacionales en materia de atención a personas privadas de libertad y administración de centros penales ( como por ejemplo las Reglas Nelson Mandela y las Reglas de Bangkok ), UNODC dispone de una serie de Manuales sobre Justicia Penal y otras publicaciones relevantes relacionadas con la reforma penitenciaria , la prevención del VIH – SIDA , y la atención y tratamiento a las personas privadas de libertad incluyendo a los colectivos en especial situación de vulnerabilidad . 3
