We are also working to equalise, in the present system as well as in
the new penitentiary system, a real penitentiary career. Agent “x”
is agent “x” until he retires in twenty years. They don’t have any
promotion possibilities and that’s why they don’t have a future, and
they have the same salary from when they started until they retire
nor do they have an institutional growth. This didn’t exist and it is
being worked on, it still hasn’t been concluded and we hope it will
in a near future.
JT: What would you like to highlight, to finish this interview?
RG: I would like to greet our sponsors, especially SEJUST
and the support from the European Union, they are truly
fantastic. And we have just had a visit from an expert looking
to bring the prison officers closer to the multidisciplinary teams.
Additionally, I would like to greet our american sponsors
that have helped us with a lot of synergies. We advanced
with one center and in very little time we have moved the
detainees that were doing a lot of damage from there and
in two weeks we managed to reduce crime rates by 50%.
Roberto Santana and Ysmael Paniagua: they are fantastic because
they respond to our worries that come up at any time and they
are always open to helping us with practical information
from their reform example in the Dominican Republic.
With the new penitentiary reform, one day we are working to take
them (offenders) to the penitentiary center and the other we are
working to make them better citizens. It is truly an honor to be in
this exercise (of penitentiary reform) now. //
Una inquietud que tenía el representante en Guatemala del Gobierno
Americano es que nosotros estamos apoyando la implementación de
esta nueva política con nueva gestión y nuevo personal, pero ¿qué
íbamos a hacer con los guardias carcelarios que tenemos para
cambiar esa mentalidad, para cambiar esa metodología y para
enfrentar un poco el exceso de corrupción instalada en el viejo
sistema? Yo le dije dos cosas que estamos a hacer: empezamos a
seleccionar pequeños grupos de guardias a quiénes capacitamos
para desarrollar su labor de acuerdo con los protocolos de actuación
del nuevo modelo, lo hicimos en pequeños centros; adicional, se
les mejoró su ingreso salarial en el año pasado, porque otro de los
reclamos era que tenían un salario de hambre, y es una realidad; y,
adicional, algo que observamos que es una debilidad real que es la
que no permite en absoluto generar las depuraciones administra-
tivas, es que no existe, en el sistema penitenciario, un reglamento
interior de sanciones y, por lo tanto, alguien [algún guardia] a
quien se le sorprende ingresando bebidas alcohólicas o cualquier
otra cosa que genere desorden dentro de la cárcel es consignado,
el juez le da libertad y al otro día llega a trabajar porque no está
normado que eso es prohibido aunque en general esto ocasiona
mucho desorden. Se le apoyó al sistema, al equipo de esta oficina,
haciendo un reglamento interior, se le trasladó al equipo técnico
del sistema penitenciario para que ellos dijeran que cambios
necesitaba y está por implementarse ahora. En la medida en que
no existe un sistema de sanciones, pues esto va a ser una anarquía.
También estamos trabajando para igualar, tanto en el sistema
actual como en el nuevo sistema penitenciario, una verdadera
carrera penitenciaria... El agente “x” es el agente “x” hasta que
se jubile dentro de veinte años, no tiene una escala de ascensos
y por lo tanto no tiene un futuro y tiene el mismo sueldo
desde que ingrese hasta que se jubile ni tiene un crecimiento
institucional, eso no existía y se está trabajando, todavía no se
ha concluido y esperamos que se tenga en un futuro cercano.
Mr. Ricardo Guzmán Loyo is the first Vice minister of Safety of

in Juridical and Social Science by the San Carlos de Guatemala
University; lawyer and notary, he also has superior studies of
