On May 29, 2025, Colorado Governor Jared Polis vetoed House Bill 1004. The legislation would have prohibited the sale, distribution or use of algorithmic devices intended to set or recommend rents or occupancy levels and designated violations as an illegal restraint of trade or commerce under the state’ s antitrust laws.
In his veto letter, Governor Polis raised concerns that this measure might restrict the use of valuable technologies for housing providers and renters in the state.
“ Reducing market friction through legitimate means that do not entail collusion is good for both renters and landlords,” noted Governor Polis.“ We should not inadvertently take a tool off the table that could identify vacancies and provide consumers with meaningful data to help efficiently manage residential real estate to ensure people can access housing.”
Governor Polis mentioned that such a ban could have“ unintended consequences of creating a hostile environment for providers of rental housing and could result in further diminished supply of rental housing based on inadequate data.”
Alongside its coalition partner, the Colorado Real Estate Alliance, the Colorado Apartment Association( CAA) led steadfast advocacy in opposition to this onerous legislation which resulted in its failure to pass for the second year in a row.
