are within five miles of a major military installation. To construct a building
taller than 200 feet, the following requirements must be met:
Endorsement from the Building Code Council.
Provide written notice to the commanders of the nearby installation.
Obtain from the commander a detailed description of possible
adverse effects, including vertical obstruction and frequency
disturbances.
A written "Determination of No Hazard to Air Navigation" issued by
the FAA.
Beaufort County does not regulate the height or placement of cell
towers within its jurisdiction.
Bertie County does not regulate the height or placement of cell
towers within its jurisdiction.
The Building Code Council has the authority to override local zoning and
approve or deny the request to build the structure. The Council must act
within 30 days, or the construction can go forward under a presumption of
approval.
Findings
Dare County’s Wireless Telecommunications Facilities Ordinance and
Hyde County’s Wireless Telecommunications Facilities Ordinance do
not identify potential issues with the height or siting of
telecommunication towers in areas under MTRs.
North Carolina’s Wireless Telecommunications Facilities Bill does not
identify potential issues with the height or siting of
telecommunication towers in areas under MTRs.
Tyrrell County does not regulate the height or placement of cell
towers within its jurisdiction.
