What is personal injury? How are negligence cases funded? Personal injury claims result from incidents that are not your fault and can occur in a vast range of situations and locations, including but not limited to, the workplace, on the road, on the street and in a home. Again, as previously mentioned, the aim is to financially compensate you for the treatment costs, the general pain and suffering, and any future care and treatment you may need. Call T G Baynes on 020 8301 7777, or email their specialist team at [email protected] and ask us for a free review of your claim. Once they have reviewed the information you have sent to support your claim, they will call to discuss the strength of your claim and whether it can be pursued, as well as relevant funding options. What is dental negligence? Dental negligence is the term used where you have undergone dental work which has been either substandard or your dentist/hygienist has caused unnecessary pain, suffering or injury. Dental negligence cases have been rising in recent years as patients have become more aware of their rights. The aim of a compensation claim is first for the unnecessary pain and suffering and second to obtain monies to fund the costs of treatment incurred over and above that which you would have required in any event. What is cosmetic surgery negligence? Cosmetic surgery claims are a form of clinical negligence claim, which has been outlined previously. It is important to note that it is not always possible to obtain the results desired even if there is no attributable negligence. However, there are many cases where undesired results are due to this and further surgery is required. Again, the purpose of the compensation claim is to try and put you in the position you would have been had it not been for the fault, and the monies obtained in a successful claim can assist in further surgeries and treatment for any emotional trauma which may have been caused. Legal aid is not generally available for claims these days other than for injuries suffered at birth. If T G Baynes can assist, they offer their legal services on a ‘no win no fee’ basis, which is also known as a Conditional Fee Agreement (CFA). This is an arrangement between yourselves and T G Baynes Solicitors, that they will waive their claim to legal costs if the claim is unsuccessful. Often these agreements are coupled with a self- insured insurance policy to cover you against adverse costs to ensure that absolutely no monies are due from you in the event that the claim is unsuccessful. Should your claim for compensation succeed, T G Baynes will seek the majority of the legal expenses from the defendant. The most appropriate funding methods and the full details will be discussed with you as part of the initial consultation with a solicitor. All funding arrangements are subject to T G Baynes terms and conditions and will be fully explained and provided at your first consultation with your solicitor.
