NEW OSHA ( Amendment 2022 ) – A Paradigm Shift for Occupational Safety

The Occupational Safety and Health Act ( Amendment ) 2022 ( Act A1648 ), “ OSHA ( Amendment 2022 )”, was passed in Parliament and subsequently gazetted on March 16 , 2022 . OSHA ( Amendment 2022 ) introduces the latest amendments to the Occupational Safety and Health Act 1994 ( Act 514 ) and replaces Factories and Machinery Act 1964 ( Act 139 ), which will be repealed . However , the implementation of OSHA ( Amendment 2022 ) is still pending the enforcement date , which will be decided by the Minister of Human Resources .
The Occupational Safety and Health Act ( Amendment ) 2022 , is an umbrella Act to protect the safety and health of all persons at works and those affected by persons at work . The OSHA Act philosophy is based on self-regulation and states that “ the responsibility for safety and health in the workplace lies with those who create the risks ( employers ) and those who work with the risks ( employees ).”
The objectives of OSHA ( Amendment 2022 ) is to consolidate both the Occupational Safety and Health Act 1994 ( Act 514 ) and the Factories and

Employers need to be made aware of some of the salient provision in the new OSHA ( Amendment 2022 ).
