Under Section 40 Planning Permission , Act 645 , all conservation works that were planned to be carried out should get approval from the NHD before the work starts . We should try to avoid being reprimanded by the relevant authorities and steer away from any conflict of interests .
CONFLICT OF INTERESTS
Conflicts of interests often arise when the roles , responsibilities and boundaries of each stakeholder are not clarified from the beginning . Most conservation projects face a lot of issues when there is no clear boundary to differentiate the roles and responsibilities of each stakeholder . The issue always arises when the same consultant is appointed with two different roles , whereas the boundary should be clearly defined so that the order made does not contradict or support his / her own decision when the particular individual uses the same hat for the same project .
The heritage legislation context should also stand on its own without any interference by the third party ’ s ideas , which sometimes are biased and might lead to conflict of interest . Everyone should know their boundaries , roles , responsibilities and accountability , whether they are in the Government or private sector . Some people try their best to manipulate the decision made by the NHD for their own purpose . In the end , the conflict of interest should be resolved so that the project can be carried out smoothly .
WAY FORWARD
In any conflict management process , understanding and incorporating the uncertainties involved must also be considered so that the resolution can integrate both legal aspects and best practices . Some conflicts might share similar problems and should be well understood so that the problem can be resolved .
Furthermore , differentiating between impacts , conflicts and prioritising conflicts in need of management can be cost-effective and reduce future costs . As a matter of fact , no building conservation conflict has ever been fully resolved in the sense that the conflict is fully eliminated . There has been varying degrees of success in managing conflicts to minimise their destructive nature .
Other suitable solutions include top-down options , such as imposing solutions and enforcing laws , as well as bottom-up options , such as working with individual stakeholder groups . Regardless of the decisions at this stage , time should be taken by decision-makers to communicate what and why some courses of actions should be taken , which in turn will increase not only transparency but also trust with other stakeholders .
