As of August 2024 , significant changes in real estate commission laws are reshaping how real estate transactions are conducted . These new regulations , designed to increase transparency and fairness , present both challenges and opportunities for buyers , sellers and agents alike . WHAT HAS CHANGED ?
Traditionally , real estate commissions have been somewhat cloudy , with the seller typically covering the cost of both the listing agent and the buyer ’ s agent . However , the new law requires greater transparency , allowing both buyers and sellers to see exactly how commissions are split and who is paying for what . In fact , sellers will no longer have to pay commission to the buyer ’ s agent at all . This change offers buyers the potential for savings , but it also means that they need to be more informed and proactive in their negotiations .
Buyers often had little insight into the commission structure , which was bundled into the overall cost of the home . Going forward , all buyers will be required to have a signed agent agreement in place prior to being able to “ house hunt ” ( there is an exception for open houses ) and can negotiate the commission rate with their agent directly .
