FIREWORKS CODE

In September 2022, Act 74 of 2022 went into effect. Act 74 updates the current fireworks law to address the illegal use of consumer fireworks. While much of the underlying 2017 law remains unchanged, there are updates aimed at curbing the illegal use of consumer fireworks. The Act also includes updates to display fireworks provisions and fireworks sales. On June 13, 2023, the Township adopted Ordinance 2023-5, which codified portions of Act 74 in Chapter 40, Article IX, Fireworks of the Millcreek Township Code.

Ground and hand-held sparkling devices, even though labeled as " fireworks ". These include party poppers, sparklers, smoke bombs, etc.
Smaller fireworks intended for personal enjoyment. Available for purchase without an ATF license or permit. May be purchased at stand alone, permanent structure( e. g. aerial spinners, Roman Candles, mines, shells, cakes, missiles, firecrackers, rockets, chasers, fountains).( See § 40-65)
Commonly called“ Commercial Fireworks”. Larger fireworks intended for public / private displays. Must have ATF license or permit, and an operational permit issued by the Township.( See §§ 40-65, 40-66)
In order to purchase, possess and use consumer fireworks, a person must be at least 18 years of age. In addition, a person may not intentionally use Consumer Fireworks if:
# 1 * On private property or on public property, including but not limited to, streets, parking lots, sidewalks and parks, without the express permission of the owner or entity that controls the property.
# 2 * Within, directed at or directed from a vehicle or building. * Directed at another person.
# 3 * While the person is under the influence of alcohol, a controlled substance or another drug.
# 4 * With one hundred fifty( 150) feet of building or vehicle, whether or not the building or vehicle is owned by user.
# 5 * Time Limitations: May not be used between the hours of 10:00pm and 10:00am expect: certain holidays listed with in the ordinance(§ 40- 67).
A person who possesses or uses consumer fireworks in violation of the law may be charged with a Summary Offense and face a monetary fine. They may also be liable to pay for any damages or costs that occur as result of using fireworks in violation of Act and the Ordinance.
To help you determine if you can use consumer fireworks on your property we have published a map indicating prohibited areas on millcreektownship. com. If you are in doubt if you can use fireworks in an area it is better to not take the chance.
SOME PEOPLE DO NOT APPRECIATE HEARING FIREWORKS AS THEY MAY INVOKE BAD MEMORIES OR DISTURB CHILDREN AND PETS. PLEASE ENSURE YOU ARE COURTEOUS IF USING ANY FIREWORKS.
