a notice of appeal. Rule 9.020 of the Rules of Appellate Procedure indicates that the 30-day period is tolled by motions for rehearing filed with the Judge of Compensation Claims. Conversely, the administrative code of procedure that allows motions for rehearing states that such a motion does not toll the time to appeal. Rule 60Q-6.122( 3). In this case both parties filed motions for rehearing. The Judge granted one motion but
did not rule on the other. Claimant appealed more than 30 days after the original order, and the First District ruled that the time to appeal had not only not expired, but it was premature because the Judge never ruled on the other motion. The case was sent back for the Judge to rule on the other pending motion.
Finally, in Mavis Tire v. Lowrey, 1D2024-2459( October 8, 2025), an order was entered awarding claimant an evaluation by a general surgeon to determine whether the claimant had a hernia and
causation, and it also awarded treatment of the hernia condition. The First District held that the award of an evaluation to make a determination of medical condition and causation was affirmed but the order to provide treatment was premature and reversed, stating that the Employer / Carrier could still contest causation in the future if treatment is recommended. n

the Young lawyers division brought members together for a morning of wellness and community service during its Yoga & Beach clean-up event on november 15 at Ben t. davis Beach. participants began the day with a relaxing yoga session before joining volunteers from keep tampa Bay Beautiful for a shoreline clean-up effort. cleaning supplies, water, and snacks were provided, and attendees enjoyed the opportunity to serve the community while connecting with fellow members. the Yld appreciates everyone who participated and helped make a positive environmental impact.
