underscores Florida’ s commitment to due process, recognizing that witness observation is critical. Aside from this limitation, the rule gives flexibility to courts in deciding what technology will advance accessibility without compromising fairness.
A recently proposed amendment to Rule 2.530 pertains to Zoom depositions. The change seeks to introduce subsection( f) requiring the deponent, the deponent’ s attorney, and the questioning attorney to be visible at all times unless otherwise ordered by the court or agreed by the parties.
This aligns with the Rule’ s spirit of fairness, seeking to capture any circumstances affecting proceedings.
Practically, Zoom offers significant advantages in litigation. It reduces travel costs and scheduling conflicts— collateral benefits from pandemic-driven remote proceedings. Challenges still remain though. Technical disparities among parties, such as unreliable internet or lack of equipment, can create inequities. Courts must weigh these“ resources of the parties” when ruling on a Rule 2.530 motion.
For attorneys, mastering the use of Zoom in legal proceedings is essential. Best practices include pre-trial testing, previewing how the court and jury view monitors, advising witnesses to use neutral backgrounds and proper lighting, and developing proficiency with electronic exhibits. Attorneys should recognize that Florida’ s rules balance technological convenience with due process. As technology evolves, so will its application, requiring practitioners to adapt. �
