Neiman Law Building 15 Bergen Street Hackensack, New Jersey 07601 (201) 488-0032 Students with Disabilities Generally, students with disabilities may be removed by a school official, including the Principal/designee, for no more than 10 consecutive or cumulative school days. The removal will be for 45 calendar days in the case of dangerous weapons possession, possession or sale of illegal drugs, or inflicting serious bodily injury upon another person while on school grounds. However, a manifestation determination must be conducted, if a student is removed for more than 10 consecutive school days or is subjected to a series of short-term removals that constitute a pattern because they cumulate to more than 10 school days in a school year and because of factors such as the length of the removals, the total amount of time the student is removed, and the proximity of the removals to one another. If, during the manifestation determination, the IEP Team determines that: 1. The conduct in question was caused by or had a direct and substantial relationship to the student‘s disability; or 2. The conduct in question was the direct result of the District‘s failure to implement the IEP. Then, the behavior will be deemed a manifestation of the student‘s disability. If the behavior is determined to be a manifestation of the student‘s disability, then the CST will conduct a functional behavioral assessment and implement a behavioral intervention plan for the student. If such plan is already in place, then the CST will modify the plan, if necessary, to address the behavior. Grievance Procedure A grievance is a formal written claim by a student or group of students who are aggrieved by reason of the application of any school rule or regulation, or of an order by a staff member or by reason of any deficiency in the school system which requires remedial action. A grievance may also involve an alleged violation related to discrimination on the basis of race, color, creed, age, religion, sex, ancestry, national origin, disability, or social or economic status or sexual orientation. 47
