not terrorist activities ( and not even a mention of an individual terrorist ). More specifically , it targets foreign powers or entities , defining them as :
A foreign power is — 1 . a foreign government ,
2 . a diplomat , other representative or employee of a foreign government ,
3 . a faction of a foreign nation that is not substantially composed of U . S . persons ,
4 . an entity openly acknowledged by a foreign government to be directed and controlled by it , or
5 . a group engaged in international terrorism or activities in preparation therefore ( Foreign Intelligence Surveillance Act of 1978 1978 ).
A different section of the FISA discusses agents of foreign powers , and in paragraph ( 2 ) states :
An Agent of a foreign power is — ( 2 ) any person who —
( A ) knowingly engages in clandestine intelligence gathering activities for or on behalf of a foreign power , which activities involve or may involve a violation of the criminal statutes of the United States ;
( B ) pursuant to the direction of an intelligence service or network of a foreign power , knowingly engages in any other clandestine intelligence activities for or on behalf of such foreign power , which activities involve or are about to involve a violation of the criminal statutes of the United States ;
( C ) knowingly engages in sabotage or international terrorism , or activities that are in preparation therefore , for or on behalf of a foreign power ; or
( D ) knowingly aids or abets any person in the conduct of activities described in subparagraph ( A ), ( B ), or ( C ) or knowingly conspires with any person to engage in activities described in subparagraph ( A ), ( B ), or ( C ) ( Foreign Intelligence Surveillance Act of 1978 1978 , vol . 1801 , sec . 101 ).
