Most recently, Tesco was fined £8m for “recklessly” polluting the environment (The Independent, 16th June 2017) following a release of 20,000 litres of fuel into a river in Lancashire. Sentencing guidelines issued to courts state that when setting the level of fines for environmental pollution offences three factors should be considered. Firstly, the Cause of the incident, secondly, the severity of Impact on the environment and lastly, the Turnover of the polluting company. It is this last aspect which has driven fines to record levels. The guidelines also state that in some cases putting the polluting company out of business may be an acceptable consequence. This presents a real and tangible business risk to fuel oil distributors who know all too well that high turnover does not easily translate into high profit.
