By Sheldon Smith
More than 100 people, including many members of the state’ s legal community, gathered on Sept. 23 in Devils Lake to bid farewell to Judge Donovan Foughty. His remarkable journey from a young law student to a respected district judge stands as a testament to dedication, integrity, and the pursuit of justice. A cherished member of the University of North Dakota( UND) School of Law Class of 1983, Judge Foughty’ s impact has been felt across the North Dakota judicial landscape and beyond.
An Impactful Career
Judge Foughty began his judicial career in 1987 when he was appointed as a county judge in Ramsey County. His keen understanding of the law and commitment to fairness quickly distinguished him as a leader in the courtroom. In 1995, with the unification of the court system, he transitioned to a district judge role, a position he held with honor until his retirement in September. Throughout his tenure, Judge Foughty was a guiding force in both the state and tribal court systems, earning the respect and admiration of colleagues and those he served.
I had the privilege of attending Judge Foughty’ s retirement ceremony, along with
UND Law School classmates Carol Johnson and Deb Klevin. Supreme Court Justice Lisa Fair McEvers facilitated the event, introducing numerous colleagues, friends, and family, all praising Judge Foughty’ s contributions to the legal profession and the profound impact he had on countless lives. His commitment to justice, advocacy for the underrepresented, and tireless work in the tribal courts were particularly highlighted, showcasing his dedication to serving all communities.
Also in attendance were Chief Justice Jon Jensen, Justice Daniel Crothers, Justice Jerod Tufte, and Justice Douglas Bahr, as well as State Court Administrator Sally Holewa and Assistant State Court Administrator Scott Johnson. Judge Foughty was gifted two Native American star quilts, symbols of honor and recognition, which encapsulate his unwavering dedication to serving and building trust with the tribal nations of North Dakota.
As Judge Foughty embarks on this new chapter of his life, the legal community will undoubtedly feel his absence. However, his legacy will continue to inspire future generations of lawyers and judges. His journey reminds us that true justice is not just a profession but a lifelong commitment
to making a difference. As we celebrate his retirement, we also celebrate the enduring spirit of service and integrity that he embodies – a legacy that will live on in the hearts and minds of those he has touched throughout his career.
