DISCIPLINARY ACTION MANAGEMENT & CCMA CASES
Disciplinary action management refers to the process that employers must follow when addressing employee misconduct or poor performance. ESS takes a structured approach to addressing misconduct and performance issues in line with our Disciplinary Policy and Procedure, which complies with the Labour Relations Act.
Our staff focus on conducting disciplinaries that are fair, consistent and procedurally correct. They ensure that disciplinary measures, such as warnings, suspensions or terminations, are applied consistently and objectively. This service provided to our clients, helps maintain workplace discipline while minimising legal risks and promoting a positive organisational culture.
OUR PRINCIPLES INCLUDE: Substantive fairness( valid reason for the action). Procedural fairness( following a fair process, including notifying the employee of allegations, allowing representation and giving them a chance to respond). Progressive discipline, where appropriate, starting with warnings before moving to more serious action like dismissal.
Our services typically include case assessment, investigation support, documentation preparation and conducting each stage of the disciplinary process. Services can also include mediation or conflict resolution strategies aimed at correcting behaviour before escalation occurs.
Employers are required to keep clear records of disciplinary procedures and ensure that sanctions are appropriate to the misconduct. Unfair disciplinary action can be challenged at the Commission for Conciliation, Mediation and Arbitration( CCMA).
