Final outcomes of education bills known
As reported previously in EdCal , ACSA had early success on the legislative front . The association co-sponsored Assembly Bill 2285 ( O ’ Donnell ), which aims to ease the earning of a teaching credential for out of state teachers . The bill was passed and signed into law .
AB 2285 removes certain educational and professional development requirements for out-of-state prepared teachers seeking a clear teaching credential , and provides additional options for these teachers to demonstrate English Language development knowledge when seeking a secondary teaching credential . It removes the requirement for out-of-state prepared teachers seeking a clear teaching credential in California to earn a master ’ s degree or complete 150 hours of professional development . Further , this bill allows out-of-state prepared teachers seeking a secondary credential in California to demonstrate English Language development knowledge by earning either the CLAD certificate or an English Learner Authorization .

AB 2808 ( Murasutchi )
This bill would have established new LCFF targets starting in 2019-20 , with the goal of reaching the national average in perpupil funding as Proposition 98 funds continue to grow . A recent decision was made by the author ’ s office to place AB 2808 on the Assembly floor ’ s inactive file , thereby concluding this year ’ s efforts on the bill . ACSA and a coalition of supporters worked hard to ensure AB 2808 received bipartisan support in both houses of the Legislature , and will work with the Legislature to reintroduce a bill in January 2019 and make a compelling case to the new governor on why new targets need to be established next year . ACSA was a co-sponsor .

AB 3096 ( Rubio )
This bill would have eliminated duplicative reporting requirements for schools and school districts and streamlines the development of the School Accountability Report Card by requiring the California Department of Education to annually complete a SARC for each school and make the SARCs available online .
Status : Placed on suspense file .
AB 1951 ( O ’ Donnell )
This bill would have , commencing in 2020-21 , given school districts the choice to administer a nationally recognized college entrance test , such as the SAT or ACT , in lieu of the Smarter Balanced Assessment Consortium for grade 11 . The Superintendent of Public Instruction is required to review national assessments to determine whether they are aligned to California ’ s academic content standards , and student assessment results would be used as part of the state ’ s accountability system . ACSA supported this bill . Status : Vetoed by governor .
AB 716 ( O ’ Donnell )
This bill aligns federal school planning requirements via the School Plan for Student Achievement with the Local Control and Accountability Plan . Single school districts will be authorized to use the LCAP to serve as their SPSA , provided the LCAP meets federal requirements . AB 716 allows schools identified for comprehensive or technical assistance under the Every Students Succeeds Act to use the SPSA to meet federal planning requirements instead of requiring a separate school improvement plan .

AB 1747 ( Rodriguez )
This bill requires school safety plans to include procedures for conducting tactical responses to criminal incidents and would require consultation with first responder entities in the development of school safety plans . The requirement to conduct annual active shooter drills was removed as a condition for passage by the Senate Appropriations Committee . ACSA supported this bill .

SB 607 ( Skinner )
This bill sought to permanently eliminate suspensions for “ willful defiance ” for grades K-5 , and prohibit willful defiance suspensions for grades 6-8 through July 1 , 2023 . While the ban was not expanded to higher grade levels , this year ’ s budget included an indefinite extension on the restriction of willful defiance for grades K-3 .

AJR 41 ( Thurmond )
Requests the United States Congress to enact , and the President to sign , legislation that would repeal the Government Pension Offset and Windfall Elimination Provision from the federal Social Security Act , and
instructs the Chief Clerk of the Assembly to transmit copies of this resolution .

AB 3120 ( Gonzales Fletcher )
This bill would have extended the time for commencement of actions for childhood sexual assault to 40 years of age or five years from discovery of the injury . It would provide enhanced damages for a cover up , as defined , of the assault . It would also provide a three-year window in which expired claims would be revived .

SB 866 ( trailer bill )
This bill enacts various statutory changes necessary to implement labor and public employment provisions for the Budget Act of 2018 . Among the provisions are :
• Public sector unions will notify district payroll offices whether an employee ’ s request to pay or not pay agency fees meets their maintenance of membership provisions .
• Requires a meet and confer to discuss any mass communication sent to an employee or applicant regarding their rights to join or refrain from joining the union . If an agreement cannot be reached , the district is required to distribute the union ’ s correspondence at the same time as the other mass communication .
• Prohibits a public employer from encouraging or discouraging union membership .
• Prohibits disclosure of the date , time and place of an employee orientation .

AB 1974 ( Gonzales Fletcher )
This bill prohibits a student or former student from owing or being billed for a debt owed to a school or school district . It also prohibits a school or district from denying credit , participation in classroom activities , library use , denying or withholding grades or transcripts , denying or withholding a diploma , limiting or barring participation in any educational activity , to a student who owes debt . A school or district can recover costs of replacement for an act of vandalism or willfully refuses to return the item unless the student is / was homeless or in / was in foster care and bars districts from using a debt collector to recover costs . Status : Signed by governor .
AB 1871 ( Bonta )
This bill guarantees low-income students attending a charter school in California access to one free or low-cost school meal each day . A hungry student is a hungry student regardless of what public school they choose to attend , and more than 340,000 low-income students attend California charter schools . ACSA supported this bill .

AB 2012 ( Medina )
This bill requires certificated employees to receive no less than 50 percent of their salary for the 12 workweek parental leave .

AB 2128 ( Kiley )
This bill defines egregious misconduct for certificated employee suspension or dismissal to include behavior or communication of a sexual nature with respect to a pupil and excludes this from the four year requirements in the Education Code . Status : Signed by the governor .
AB 2234 ( Jones-Sawyer )
The bill establishes a comprehensive set of requirements for the presentation of testimony by child witnesses at dismissal or suspension hearing of certificated employees .

AB 3205 ( O ’ Donnell )
This bill states that schools modernized after Jan . 1 , 2019 shall have doors that lock from the inside .

SB 820 ( Leyva )
This bill prohibits a settlement agreement that prohibits disclosure of factual information relating to the action for sexual assault , sexual harassment , or harassment or discrimination based on sex .

This bill uniformly applies time off without loss of compensation to public employees who are involved in collective bargaining and other union activities .

SB 1343 ( Mitchell )
This bill requires employers to provide two hours of sexual harassment training to all employees by January 1 , 2020 and once every two years after . Requires the Dept . of Fair Employment and Housing to develop a two-hour video and post it on their website for employers to utilize . Status : Signed by the governor .
