Forensics excels in authentication but ediscovery does not lend itself to it.
Imagine a scenario where the opposing
party’s key e-mail is detrimental to the
case.
A search of the documents for this and
similar e-mails doesn’t locate anything. A
forensics investigator notices inaccurate
extended header information – the e-mail
was dated after its supposed transmission.
Further investigation supports the theory
that the e-mail is not authentic and had
not been sent.
