take account of the differences between Part 5 of the Road Traffic Act 1988 before and after the amendments made by the Road Safety Act 2006.

Part 3: Consequential and related amendments

308. Consequential amendments are made to the Road Traffic (Driving Instruction by Disabled Persons) Act 1993, the Road Traffic Offenders Act 1988 and the Road Safety Act 2006.309.The extent of clause 5 and Schedule 2 is the same as the Road Traffic Act 1988 and so the provisions form part of the law of England and Wales and Scotland. They will come into force on a day to be appointed by the Secretary of State in a commencement order.

We have grave concerns that the DSA are moving from their founding remit. They are the Driver Testing and Training authority in the UK with responsibility for the Register of Approved Driving Instructors.

If the the RSA 2006 in enforced in full then DSA will also involve themselves in your driving school business practices. How someone with no business accruement can regulate privately owned businesses I don't know. Many Civil Servants have never worked in the private sector and have no idea how to run a successful business. If they did, government departments would be run efficiently on budget and for the benefit of those it serves.

There also provision within the RSA 2006 to make it a requirement in legislation to display your green badge in the vehicle whilst the car is being used on a driving test. We are aware there in many instances instructors remove their badge, as they are not doing paid instruction. Removing the badge also prevents DSA collecting data about the test and linking it to the instructor.
