Draft CalOSHA Standards Crystalline Silica | Page 4

2. Natural stone slabs and panels if the stone has not been crushed, pulverized, ground, powdered, milled, or similarly processed. 3. Sintered stone slabs and panels that contain no binders. 4. Terrazzo tiles, panels, and slabs. Terrazzo consists of chips of natural stone, glass, or shell embedded into a binder of cement or epoxy. 5. Concrete or cement-based slabs and panels that contain no other binders other than cement.
( 3)“ Artificial Stone Action Level” means a concentration of airborne respirable crystalline silica of 3.0 10 μg / m 3, calculated as an 8-hour TWA. This action level applies to both of the following:
* * * * *
( A) High-exposure trigger tasks performed on artificial stone.
( B) High exposure trigger tasks performed on any mix or variety of slabs or panels materials that include artificial stone, regardless of the proportion of artificial stone present in the slabs or panels being worked on.
( 17)“ Wet Methods” means effectively suppressing dust by one of the methods listed below, such that exposures do not exceed the action level or artificial stone action level, as applicable, at any time. Regardless of the method used, water shall cover the entire surface of the work object where a tool, equipment, or machine contacts the work object. Use of water bottles or other water source that is not a continuous and uninterrupted supply of water is not an acceptable wet method.
* * * * *( f) Methods of compliance.

( 2) Engineering and work practice controls for high-exposure trigger tasks. The employer shall use the following engineering controls and work practices for all high-exposure trigger tasks, regardless of employee exposures, exposure assessments, or objective data.
( A) Engineering Controls. Effective wet methods that reduce exposure levels below the action level shall be used at all times. Wet methods shall reduce all employee exposures below the action level or artificial stone action level, as applicable, without regard to respirator use.
( g) Imminent Hazards.
( 1) Failure to comply with any of the following subsection( f)( 2)( A), Engineering Controls, shall be considered an imminent hazard and shall be subject to an Order Prohibiting Use( issued pursuant to Labor Code Section 6325) by the Division.
( A) Subsection( f)( 2)( A), Engineering Controls;( B) Subsection( f)( 2)( D) Prohibitions; or( C) Subsection( h) Respiratory protection;
