( 4)“ Fabrication” means to process, modify, alter, shape, or otherwise transform a manufactured artificial stone slab or panel containing crystalline silica into a final or near-final product for its intended use by cutting, grinding, drilling, routing, polishing, finishing, joining, laminating or otherwise processing a manufactured slab.
( d) The employer shall notify all employees, verbally and in writing in a language understood by employees, that the manufacture or fabrication of artificial stone containing 1.0 % or more crystalline silica is dangerous to life and health, and that its manufacture or fabrication is prohibited in any workplace.
( e) The employer shall post highly visible signs at all entrances to the workplace in languages understood by employees with the following:
ARTIFICIAL STONE( ENGINEERED STONE, QUARTZ) WITH 1.0 % OR MORE CRYSTALLINE SILICA IS PROHIBITED! ARTIFICIAL STONE WITH CRYSTALLINE SILICA IS DANGEROUS TO LIFE AND HEALTH!
¡ SE PROHÍBE LA PIEDRA ARTIFICIAL( PIEDRA DE INGENIERÍA, CUARZO) QUE CONTENGA 1.0 % O MÁS DE SÍLICE CRISTALINA! ¡ LA PIEDRA ARTIFICIAL QUE CONTIENE SÍLICE CRISTALINA ES PELIGROSA PARA LA VIDA Y LA SALUD!
( f) Any manufacturing or fabrication of artificial stone with more than 1.0 % or more crystalline silica shall be considered an imminent hazard and shall be subject to an Order Prohibiting Use from the Division.
( g) Recordkeeping( 1) Documentation of product contents.
( A) The employer shall maintain documentation sufficient to demonstrate that a material contains less than 1.0 % or less crystalline silica by weight; or that the material is not artificial stone.
( B) Documentation shall include: 1. A Safety Data Sheet( SDS) in accordance with section 5194 for each Stock-
Keeping Unit( SKU); and
2. A laboratory analysis for each SKU using X-ray Diffraction from a laboratory accredited in accordance with section 5204 Appendix A provided by the importer, manufacturer, distributor, supplier, or other source.
( C) In the absence of such documentation, the employer and Division shall treat the material as artificial stone containing greater than 1.0 % or more crystalline silica by weight.
