Small Business Participation in State Contracting

HB 211 by Rogers/SB 438 by Bullard

NUCA of Florida opposes this legislation as drafted as it seeks to “unbundle” state construction contracts – meaning break them into smaller contracts that can be performed by small business entities. The objectionable sections of the bill would raise the threshold for projects that would not be required to be bonded to $500,000 – a move we have historically been opposed to as it leaves subs and suppliers without payment protection. Additionally, the bill mandates a 35% small business participation requirement which we believe is not only unattainable, but puts suppliers into the position of selling through a shell supplier in order for the state to meet those goals.

The bills revise the procedures a person must follow to obtain public records from a contractor that is acting on behalf of a public agency. Florida law subjects anyone contracting with a governmental entity to be subject to the public records law requirements.

Construction Lien Law

I will continue to be ever watchful for any effort to eliminate or weaken lien rights for subcontractors and suppliers.
