for changed conditions was denied where a dredging contract required the contractor to examine the site and make such tests and borings and decide for himself the character of the material and difficulties which may be encountered in dredging . This type of language in a contract placing all the burden on the contractor should be avoided . On the other hand , if this language is agreed to , the contractor should take any additional steps ( i . e ., inspections , testing , environmental studies ) necessary during the bid phase to account for the unexpected .
Expect the unexpected when dealing with changed or differing site conditions . It is crucial that from the initial bid phase , through the construction of the project , to potentially submitting a claim to the owner , you understand what your risks and responsibilities are . In almost every instance , the answer can be found in the bid documents or contract . Once you understand your contractual rights and obligations you can protect your company at each phase of a project .
