Public Agency Contracting
● A public agency ( including but limited to cities , counties , state agencies , and even private business entities that are acting on behalf of a public agency ( Line 370-377 )) must require in any contract that the contractor and any subcontractor , register with and use the E-Verify system to verify the work authorization status of all new employees . A public agency or a contractor or subcontractor thereof may not enter into a contract unless each party to the contract registers with and uses the E-Verify system . ( Lines 468-474 )
● If a contractor enters into a contract with a subcontractor , the subcontractor must provide the contractor with an affidavit stating that the subcontractor does not employ , contract with or subcontract with an unauthorized alien . The contractor must maintain a copy of the affidavit for the duration of the contract . ( Lines 475-480 )
● If a public agency , contractor or subcontractor has a good faith belief that a person or entity with which it is contracting has knowingly violated s . 448.09 ( 1 ) by hiring an unauthorized alien , they must terminate the contract with the person or entity . ( Lines 481- 484 )
● If a public agency has a good faith belief that a subcontractor violated the law , but the contractor otherwise complied , they shall promptly notify the contractor to immediately terminate the contract with the subcontractor . ( Lines 485-489 )
● A contract terminated under pursuant to the statute is not a breach of contract and if a public agency terminates a contract with a contractor , the contractor may not be awarded a public contract for at least one year after the date on which the contract was terminated . A contractor is liable for any additional costs incurred by a public agency as a result of the termination of a contract . ( Lines 490- 497 )
Florida Department of Economic Opportunity – Beginning July 1 , 2024
■ If the Florida Department of Economic Opportunity 3 ( DEO ) finds an employer has knowingly employed an unauthorized alien without verifying employment eligibility of the individual , DEO must enter an administrative order , subject to Chapter 120 Florida Statutes . If the employer is found to have hired an unauthorized alien , DEO will require repayment of any economic development incentives ( Lines 300-306 ).
● If DEO determines an employer has failed to use the E-Verify system , DEO must notify the employer and give the employer thirty ( 30 ) days to cure ( Lines 503-509 ).
● First violation , DEO will place the employer on probation for a oneyear period and will require quarterly reports to demonstrate compliance ( Lines 312-316 ).
● A subsequent violation within 24 months of the first violation , the
