Legislation Impacting the Florida Building Code and Florida Building Commission
In 2022 , the Florida Legislature passed three bills which require implementation by the Florida Building Commission . These bills are HB 423 , SB 1140 , and SB 4-D . You can find the text of the bills at

HB 423 creates additional timeframes and processes that local building code enforcement agencies must follow when requesting additional information from a building permit applicant . The bill becomes effective July 1 , 2022 .
SB 1140 creates a simplified permitting process for certain types of fire alarm system projects and alters the definition of a low voltage alarm system project . The bill becomes effective July 1 , 2022 .
The Florida Legislature passed SB 4-D during its special session in May 2022 . The bill became effective May 27 , 2022 . The bill creates an exception to the 25 % rule for roofs and requires that the exception be incorporated in to the Florida Building Code . The exception allows roofs or roof sections that were built to the requirements of the 2007 Florida Building Code to be repaired , replaced , or recovered even if more than 25 % of the roof is being repaired , replaced , or recovered .
SB 4-D also creates a structural inspection program for condominium buildings and cooperatively owned buildings throughout the state . SB 4-D specifically tasks the Florida Building Commission with two assignments related to these new inspection requirements . The first assignment requires the Commission to review SB 4-D and provide the legislature with any recommendations necessary to ensure the inspections described in SB 4-D are sufficient to determine the structural integrity of buildings . These recommendations , if there are any , are due in December 2022 . The second assignment requires the Commission , in consultation with the State Fire Marshal ’ s Office , to provide recommendations for the adoption of comprehensive structural and life safety standards for maintaining and inspecting all types of buildings and structures in this state that are three stories or more in height . These recommendations are due in December 2023 .
