Governor Scott’s Support
Pipeline Damage
Prevention Enforcement
The following letter by US Department
of Transportation Secretary Foxx seeks
Governor Scott’s support for legislation
in Florida to increase the safety authority
of the Florida Public Service Commission
(FPSC) over all intrastate pipelines;
establish an excavation damage
prevention program that includes
meaningful civil penalty levels with no
exemptions for excavators; and establish
an effective, fair, and balanced damage
prevention enforcement program in
Florida. Of particular concern is Secretary
Foxx’s request to Governor Scott to
support increasing the FPSC’s maximum
civil penalty to a level commensurate with
the Federal maximum penalty levels of
$200,000 per day per violation up to a
maximum of $2,000,000 for any related
series of violations, in an effort to improve
safety and prevent damage to the state’s
pipelines.
