DISCIPLINE SUMMARIES Dr. Jackiewicz’s practice has been reviewed by three independent experts over the last decade, as well as a supervisor for a period of time. They all agreed that Dr. Jackiewicz failed to maintain the standard of practice of the profession, and that he is incom- petent. They found that he was not amenable to rehabilitation, as he was unwilling to take any sug- gestions. Dr. Jackiewicz had previously appeared before the Discipline Committee in 2010, at which time he was found to have failed to maintain the standard of practice with respect to his obstetrics practice, and engaged in disgraceful, dishonourable or unprofes- sional conduct in his comments to four patients/ relatives. The Committee concluded that in light of the seriousness of Dr. Jackiewicz’s misconduct and the length of time it persisted without any effort on his part to remediate, the only appropriate action to ad- dress public safety was to remove him from practice. Had Dr. Jackiewicz not agreed to the undertaking to never re-apply to practise medicine in Ontario or any other jurisdiction, the Committee stated that it would undoubtedly have revoked his certificate of registration. ORDER The Discipline Committee ordered Dr. Jackiewicz to appear for a reprimand and to pay hearing costs of $10,180. The Committee’s decision was based on the follow- ing facts: (i) Dr. Jackiewicz’s registration to practise medicine in Ontario expired on August 16, 2018, when he did not renew his membership; and (ii) Dr. Jackiewicz signed an undertaking with the College by which he agreed to never apply or re-apply as a physician in Ontario or any other jurisdiction. DAVID HAROLD DOUGLAS JONES PRACTICE LOCATION: London AREA OF PRACTICE: General Practice HEARING INFORMATION: Plea of No Contest; State- ment of Uncontested Facts; Joint Submission on Penalty On October 1, 2018, the Discipline Committee found that Dr. Jones committed an act of professional mis- conduct, in that he has engaged in conduct or an act or omission relevant to the practice of medicine that, hav- ing regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional. The Discipline Committee found that Dr. Jones made inappropriate and unprofessional comments to Patient A while conducting intimate examinations by commenting on her appearance and inquiring about her interest in obtaining a tattoo in her vaginal area. At a prior appointment, Dr. Jones also made a crude comment to Patient A and her mother, indicating that he found a celebrity on a magazine cover attractive. The agreed statement of facts on penalty outlined that Dr. Jones has a history of three complaints to the College for similar misconduct. He has no his- tory before the Discipline Committee. One of these complaints preceded the conduct involving Patient A and was viewed as aggravating by the Committee, particularly because Dr. Jones had been cautioned and had completed the Boundaries course shortly before the conduct involving Patient A. ORDER The Discipline Committee ordered: a two-month suspension on Dr. Jones’ certificate of registration; a reprimand; and a requirement that Dr. Jones suc- cessfully complete the PROBE course in ethics and boundaries.
