DR. ROMAN FEIGEL

On June 11, 2018, the Discipline Committee found
that Dr. Feigel committed an act of professional
misconduct in that: he has engaged in sexual abuse of
patients, and in that he has engaged in an act or omis-
sion relevant to the practice of medicine that, having
regard to all the circumstances, would reasonably be
regarded by members as disgraceful, dishonourable or
unprofessional.
Patient A
As Patient A was leaving an appointment with Dr.
Feigel in January 2014, Dr. Feigel told her that she
was “sexy” and made a gesture indicating masturba-
tion. The Committee found that Dr. Feigel’s remarks
and accompanying gesture were remarks and behav-
iour of a sexual nature and constitute sexual abuse of
a patient. The Committee also found this constitutes
disgraceful, dishonourable or unprofessional conduct.
At another appointment, Dr. Feigel told the patient
that she had a “nice tummy” or “nice belly.” The
Committee found that the fact that the comment was
made during a physical examination was concern-
ing, but without further details, the Committee was
not prepared to conclude that an objective observer
would find this to be a comment of a sexual nature.
However, the Committee found that commenting
that Patient A had a nice tummy or belly during a
physical examination constitutes disgraceful, dishon-
ourable or unprofessional conduct.

Patient B
The Committee found that Dr. Feigel engaged in sex-
ual abuse of Patient B, by making remarks of a sexual
nature prior to and during the course of intimate
physical examinations at a medical appointment. The
Committee also found that this constitutes disgrace-
ful, dishonourable and unprofessional conduct.
Undertaking
On November 22, 2018, Dr. Feigel signed an under-
taking resigning from the College effective January 1,
2019 and also undertook not to apply or re-apply for
registration as a physician to practise medicine in On-
tario or any other jurisdiction after the effective date.
ORDER
The Discipline Committee ordered: a reprimand;
reimbursement to the College for funding provided
to patients under the program required under section
85.7 of the Code, by posting an irrevocable letter
of credit or other security acceptable to the Col-
lege, within 30 days of this Order in the amount of
$32,120.00; and payment to the College for hearing
costs in the amount of $33, 500.00
