DISCIPLINE SUMMARIES requiring, among other things, that Dr. Tamari maintain a log of all requests received for third party reports and medical records indicating when such requests were made and when they were fulfilled. Dr. Tamari failed to maintain a complete and accurate Log with respect to Patients B, C, D, E, F, G, H, I and J and their families. Provision of Information to Hospital In January 2017, Dr. Tamari answered “no” to the question of whether he was the subject of any com- plaint, investigation, or review by a licensing body on his re-application for privileges, despite the fact that he was the subject of at least four College investiga- tions as of January 2017 and other College investiga- tions in 2016. ORDER The Discipline Committee ordered: a six-month suspension; a reprimand and term; conditions and limitations on Dr. Tamari’s certificate of registration. Dr. Tamari was also ordered to pay hearing costs in the amount of $10,180.00. The terms, conditions and limitations include: not engaging in the practice of general family medicine or be the primary care provider for any patient what- soever; restricting his practice to performing minor surgical procedures in an office-based setting and sur- gical assisting in a hospital-based setting; successfully completing an instruction in ethics; and 12 months of clinical supervision. Dr. Tamari is also required to maintain a log of all requests for medical records and third party reports made by patients, other physicians or third par- ties. He is required to deliver all existing medical records to all patients and/or third parties included in the Notice of Hearing, within 60 days of receiving patient consent. Dr. Tamari shall retain and employ an administrative assistant who will be present at all times that Dr. Tamari is practising in his office. APPEAL SUMMARIES Dr. Mory Mayer Gutman The decision of the Discipline Committee was pub- lished in Issue 3, 2018. Dr. Gutman appealed the penalty decision to the Divisional Court. On November 18, 2018, the Divi- sional Court dismissed Dr. Gutman’s appeal. Dr. David James Hill The decision of the Discipline Committee was pub- lished in Issue 1, 2018. Dr. Hill appealed the findings of the decision. On October 3, 2018, the Divisional Court dismissed Dr. Hill’s appeal with costs to the College in the amount of $10,000. Dr. Hill is seeking leave to appeal to the Court of Appeal. Dr. Rob Joseph Kamermans The decision of the Discipline Committee was pub- lished in Issue 3, 2018. Dr. Kamermans appealed the Discipline Commit- tee’s finding on penalty to the Divisional Court. On November 8, 2018, the Divisional Court dismissed Dr. Kamermans’ appeal. Dr. Andrew Winston Taylor The decision of the Discipline Committee was pub- lished in Issue 3, 2018. Dr. Taylor appealed the finding. The appeal was heard on June 11, 2018. The Divisional Court dismissed Dr. Taylor’s appeal on September 4, 2018 with costs to the College in the amount of $15,000. On October 2, 2018, Dr. Taylor filed a motion seeking leave to appeal the Divisional Court Decision. Dr. Taylor’s motion for leave to appeal to the Court of Appeal was dismissed with costs in the amount of $2500. At the conclusion of the hearing, Dr. Tamari waived his right to an appeal and the Committee administered the public reprimand. ISSUE 1, 2019 DIALOGUE 67
