The expert also reviewed five further patient charts received from Dr. Raymond Wu’s own family practice clinic and noted no concerns with regard to these five charts and patient care. The expert opined that Dr. Raymond Wu met the standard of care expected of a family physician in a busy urban setting. ORDER The Discipline Committee ordered: a one-month suspension of Dr. Wu’s certificate of registration and a reprimand. He was also ordered to pay costs of $6,000. TSAI HSING YU PRACTICE LOCATION: St. Catharines AREA OF PRACTICE: General Practice HEARING INFORMATION: Admission; Agreed Statement of Facts; Joint Submission on Penalty On November 24, 2017, the Discipline Committee found that Dr. Yu committed an act of professional misconduct, in that he engaged in an act or omis- sion relevant to the practice of medicine that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable, or unprofessional. Dr. Yu obtained a certificate of registration autho- rizing independent practice in Ontario in 1984. Dr. Yu has a family and walk-in practice in St. Catha- rines, Ontario. 2016 UNDERTAKING On July 27, 2016, as a result of a College investiga- tion, Dr. Yu entered into an undertaking with the College. Pursuant to the 2016 undertaking, Dr. Yu agreed not to issue new prescriptions or renew existing prescriptions for any narcotics, controlled or monitored drugs, or benzodiazepines or other targeted substances, with the exception of certain specified drugs which he is permitted to prescribe where clinically indicated. BREACH OF THE 2016 UNDERTAKING Between September and November 2016, inclusive, Dr. Yu renewed prescriptions for controlled substanc- es for three patients on three occasions: • In October 2016, Dr. Yu renewed a prescription for Sublinox for Patient A; • In September 2016, Dr. Yu renewed a prescription for Lorazepam for Patient B; and • In November 2016, Dr. Yu renewed a prescription for Lorazepam for Patient C. These substances are not among the specified drugs Dr. Yu is permitted to prescribe pursuant to his 2016 undertaking. By authorizing these prescription renewals, Dr. Yu breached his 2016 undertaking with the College. Although this was Dr. Yu’s first time before the Discipline Committee, it was his second breach of an undertaking with the College. This raised concern for the Committee about Dr. Yu’s governability. Dr. Yu had reached an agreement with the College after breaching his 2011 undertaking. Part of that agree- ment was signing the 2016 undertaking, which he then breached almost immediately with three sepa- rate prescription renewals. The Committee found that although the breach may have been uninten- tional, it does not negate the seriousness of breaching an undertaking with the College. ORDER The Discipline Committee ordered: a three-month suspension on Dr. Yu’s certificate of suspension; a reprimand; and costs to the College in the amount of $5,500.00.
