These records were ultimately received by the College
on July 18, 2016.
It was found that Dr. Fenton is incompetent and
failed to maintain the standard of practice in his care
and treatment of Patient D, as described above. Dr.
Fenton engaged in conduct that would reasonably be
regarded by members as disgraceful, dishonourable or
unprofessional in his failure to respond to inquiries
from the College within a reasonable time
On March 3, 2017, Dr. Fenton entered into an un-
dertaking that he shall no longer prescribe or renew
any and all narcotic drugs, narcotic preparations,
controlled drugs, benzodiazepines, other targeted
substances and all other monitored drugs.
ORDER
The Discipline Committee ordered: a six-month
suspension on Dr. Fenton’s certificate of registration;
terms, conditions and limitations on Dr. Fenton’s
certificate of registration; a reprimand; and payment
to the College of costs in the amount of $5,500.
The terms, conditions and limitations include:
successful completion of a medical record-keeping
course, a primary care course, the Understanding
Boundaries course; individualized instruction in
ethics; and individualized instruction in communica-
tions. It also includes a 12-month period of clinical
supervision, with varying levels of supervision in
response to the findings of the clinical supervisor; a
reassessment six months after the clinical supervision
ends; cooperation with unannounced inspections
of his practice; providing consent to the College to
make inquiries of OHIP, the Drug Program Services
Branch, the Narcotics Monitoring System, and/or
any person who or institution that may have relevant
information, in order for the College to monitor a
