examining her. While he was palpating Patient B’s
abdomen with one hand, without warning, Dr. Jiara-
vuthisan placed his other hand below her underpants
on her mons pubis for approximately 30 seconds. Dr.
Jiaravuthisan advises that any such contact would
have been inadvertent, as he intended only to palpate
Patient B’s suprapubic area.
Dr. Jiaravuthisan then directed Patient B to roll
over to examine her tailbone area where she said that
she had been experiencing pain. Dr. Jiaravuthisan
palpated Patient B’s tailbone area underneath her
clothing. In the course of doing so, he touched Pa-
tient B’s buttocks in what felt to her like a squeezing
motion. In examining Patient B’s face, Dr. Jiara-
vuthisan also touched her face in a manner that felt
to her like grabbing.
Dr. Jiaravuthisan did not show sensitivity and re-
spect for Patient B’s comfort by maintaining spatial
boundaries, communicating appropriately regarding the
examination, and offering draping. Because of this, the
appointment was very distressing to Patient B. Dr. Jiara-
vuthisan’s conduct in this regard was unprofessional.
Afterwards, Patient B told office staff, in tears, that
she did not like how Dr. Jiaravuthisan had touched
her and did not want to return. She also expressed
her concerns to her family physician.
On October 19, 2016, Dr. Jiaravuthisan entered
into an undertaking with the College agreeing to re-
sign his certificate of registration effective November
7, 2016, and not to reapply for a certificate in future.
ORDER
In light of Dr. Jiaravuthisan’s undertaking to resign
his certifica te of registration and not to reapply, the
Discipline Committee ordered: a reprimand, and
payment to the College costs of this proceeding in
the amount of $5,000.

At the conclusion of the hearing, Dr. Jiaravuthisan
waived his right to an appeal and the Committee ad-
ministered the public reprimand.
DR. RAVI KAKAR
PRACTICE LOCATION: Markham
AREA OF PRACTICE: Psychiatry
HEARING INFORMATION: Admission; Agreed Statement of
Facts; Joint Submission on Penalty
On December 12, 2016, the Discipline Committee
found that Dr. Kakar has committed acts of profes-
sional misconduct, in that he has failed to maintain
the standard of practice of the profession; and he has
engaged in an act or omission relevant to the practice
of medicine that, having regard to all the circum-
stances, would reasonably be regarded by members
as disgraceful, dishonourable, or unprofessional. The
Discipline Committee also found that Dr. Kakar is
incompetent.
Patient A
In October 2012, Patient A complained that Dr. Ka-
kar diagnosed her with gout arthritis and prescribed
a medication, Allopurinol, to which she had a severe
allergic reaction resulting in serious side effects.
Patient A had started seeing Dr. Kakar for psy-
chiatric care in August 2010. Dr. Kakar diagnosed
Patient A’s mental health issues and chronic pain, and
prescribed psychiatric medications. Dr. Kakar also
requisitioned blood work.
In September 2010, Patient A attended for a
follow-up appointment to discuss her psychiatric
conditions. At this visit, Dr. Kakar observed that the
blood work results showed elevated uric acid levels,
diagnosed gout arthritis and prescribed Allopurinol.
There was no emergency or urgency requiring that
Dr. Kakar treat Patient A at that time.
Patient A filled the prescription for Alluporinol on
a date in early October 2010 and developed side ef-
fects including a fever and cough, a generalized rash,
and swelling of the mouth, lips and tongue. Her side
effects worsened into severe pain, swelling of the feet,
