Key Reprimand Points • Th  e Committee viewed as extremely serious the criminal offence that resulted in Dr. Sinclair appearing before Discipline. The Committee noted that the court has already imposed a very significant penalty, and in doing so, demonstrated that society will not tolerate this behaviour. • The Committee also noted that egregious offences of this nature result in serious damage to public trust and confidence in the medical profession. Dr Sinclair brought dishonour to the profession, himself and his family with wide ranging effects. • The Drug Benefit Plan and other health system entities were defrauded. In addition, Dr. Sinclair’s possession and ultimate trafficking of narcotics appears to have been motivated entirely by profit. • The Panel expressed its abhorrence of Dr. Sinclair’s participation in a scheme that put narcotics on the street for the drug trade, and had the potential to cause harm and potential death to those who purchased the drugs on the street. Appeal summaries Dr. Naeem Hafiz Muhammad London The decision of the Discipline Committee was published in Dialogue, Issue 3, 2014. On May 9, 2013, Dr. Muhammad appealed the finding decision of the Discipline Committee to the Superior Court of Justice (Divisional Court). On June 18, 2014, the Divisional Court dismissed Dr. Muhammad’s appeal. Dr. Sami John George Karkanis No practice address The decision of the Discipline Committee was published in Dialogue, Issue 4, 2013. On May 9, 2013, Dr. Karkanis appealed the finding and penalty decisions of the Discipline Committee to the Superior Court of Justice (Divisional Court). On December 4, 2014, the Divisional Court allowed Dr. Karkanis’ appeal and returned the matter for rehearing should the College determine that the matter be pursued.
