Thus every effort was made by the UCC management , to cover up its monstrous criminal culpability for creating the Bhopal industrial disaster and unending devastation .
On the other hand , the government of India declared the Bhopal victims as ‘ wards ’ of the Indian state , to avoid the American lawyers representing the victims for a large sums of compensation claims from U . C . C in American courts . The Indian government unilaterally represented the victims in its suit against UCC . With the pleading of UCC , the case be tried in India , the case went to trial in India . In 1989 after five year of the accident the government of India decided to accept an out of - court settlement for a paltry sum of $ 470 million in compensation from Union Carbide , settling the matter in perpetuity . In 1991 the Indian Supreme Court , upheld the 1989 settlement of compensation for $ 470 million .
In 1992 UCC announced that it would sell its 50.9 % stake and put $ 17 million of sales in to a trust aimed at building a hospital for accident survivals . In 1994 the December-2024
Supreme Court allowed UCC to go ahead with sales . The majority of the stake in UCIL was bought up by Mc Leod Russel India Ltd , an Indian company owned by the B . M . Khaitan group , in effect Bhopal factory became the asset of another new owners . Subsequently it was bought up by Dow Chemical Corporation , and the DOW Company becoming the present owner of Bhopal factory . This is a classic example of corporate manipulation intended to escape from criminal liability . The criminal case against UCC is left unresolved .
The apathy of Indian state towards the victims was unequalled . The Indian state in complicity with the UCC had facilitated UCC to evade paying adequate compensation to gas disaster victims , and helped UCC and its successors to escape from the criminal liability of creating Bhopal industrial disaster , killing and maiming people for generations and polluting the environment in and around Bhopal city .
The present owner of Dow Chemical Company stubbornly refuses its legal liability as the successor of UCIL ’ s Bhopal factory arguing and insisting that it had no connection to Bhopal at all . The premises of Bhopal factory remains contaminated .
The business tycoon Ratan Tata , a partner of DOW , along with other partners , a group of Indian industrialists many of them luminaries of so-called India - US CEO Forum , offered in 2007 , to clean up the Bhopal factory if only the government of India ‘ would ’ agree to let DOW operate in India without ‘ legal liability ’. Conclusion :
In the present day India encompassed with the paradigm and ideology of neo-liberalism of imperialist capitalism , an attitude has developed among upper classes that victims and their supporters are holding back India ’ s inexorable progress . The elite that loves to love US corporations and loves to hate the poor has made significant efforts to make sure that DOW feels welcome and fully at home in India .
This is how with the unholy nexus between the foreign private capital , comprador Indian industrialist capitalist class and Indian state have cunningly left the Bhopal gas disaster victims without necessary and adequate mitigation , in perpetuity . This is how the Indian big-bourgeoisie class which is a comprador to the imperialist capitalism and an important and a main ruling class in India , along with the Indian state , represented by its agents as the rulers who too are subservient to global capital of imperialism has committed such a treachery against the people of India and the nation .
Even now the same unholy combination of imperialist transnational capital , Indian comprador bourgeoisie class and its representative agent rulers are ruling and governing the Indian government .
In this connection , a glaring question arises , as to how the mainstream journalists , commentators and politicians who have been for all these years posing as the champions of Bhopal gas victims , have conveniently and a conspicuously forgotten to question - the culpability of the Indian share holders - the Indian industrialists and politicians of the main ruling political parties , who own 49.1 % of UCIL stocks and some of these who are prominent members of the board of directors of UCIL ? Till this day no where it was revealed as to who were those prominent Indian politicians and industrialists that were board members of the UCIL . Such is the cunning skill of our Indian big-media and the so-called mainstream intellectuals , reputed journalists and academic researchers in covering
