Insurance claims landscape
The insurance claims landscape has changed dramatically over the last few years. Before July 2021, Floridians had 5 years from the date of loss( the day that the weather event occurred that caused damage to the property) to file an insurance claim. New laws significantly reduced that time. Policyholders now have only 1 year to report a loss. At the same time, policy coverage has been reduced, the burden of proof has shifted more heavily to the policyholder, and attorney fee laws have changed. In the past, when a policyholder won in court, attorney fees were typically paid above and beyond the claim recovery. Today, those fees often come directly out of the damages awarded.

What that means:
If the insurance carrier does not pay your claim properly and litigation becomes necessary, even a successful outcome in court may result in 33-40 % of the recovery going toward attorney fees.
