Both R-22 and R-141b are affected by the HPMP . As of September 1 , 2014 , the recovery and recycling of controlled HCFCs has been mandatory in South Africa , which is further controlled by local National Standards such as SANS 10147:2014 ( viz ., para . 1.1 and E . 4 ) [ 14 ].
Additionally , as of 1 January 2015 , a license is required for anyone purchasing these refrigerants [ 13 ], although many alternative refrigerants are available for use instead of these HCFCs . Further legal requirements instituted in aid of achieving the intended reductions are provided in Table 3 .

Quota system for the assignment of import licenses for all HCFC . 1 January 2013
Ban on import of HCFC-141b either in pure form or as a component of blended chemicals ; for the purpose of placing on the market or use in the production of polyurethane foams or as solvents or any other application .
Ban of import of any new or used air conditioning systems or equipment fitted with a compressor and pre charged or partially charged with HCFC-22 or any refrigerant or refrigerant blend containing any HCFC .
Ban on the use of HCFC-22 ( or any other refrigerant containing HCFCs ) either in pure form or as a component of blended refrigerants ; in the construction , assembly or installation of any new refrigeration or air-conditioning system or equipment which requires a compressor to be fitted in South Africa .

CONCLUSION
The source of these limitations derives from the work undertaken by the parties to the ‘ Montreal Protocol on Substances that Deplete the Ozone Layer ’, of which South Africa is one and which South Africa has ratified and accedes to [ 2 ]. Environmental protection as a legal concept is very common , so the Montreal Protocol and subsequent amendments are by no means unique or novel in their endeavours .
In South Africa , “ the Constitution provides a legal foundation for government to undertake all the necessary efforts to ensure that the environment is safe and clean for all .
Furthermore , Chapter 5 of the South African National Development Plan ( NDP ) which has targets to be achieved by the year 2030 , is dedicated to Environmental Sustainability which can be achieved through protecting & enhancing our environmental assets and natural resources .” [ 12 ]
By ratifying the Kigali Amendment , South Africa simply strengthens its position on environmental protection and continues the work undertaken in previous rounds of the Montreal Protocol .

Having now added HFCs to the Protocol via the Kigali Amendment , the ozone layer can be protected more holistically .
