The federal government refuses to move marijuana from SCHEDULE 1 (CLASS I) DRUGS. Drugs in this classification are illegal because they have high abuse potential, no medical use, and severe safety concerns; for example, narcotics such as Heroin, LSD, and cocaine. Marijuana is also included as a Class 1 drug despite it being legal in some states and it being used as a medicinal drug in some states. SOURCE. This is ironic considering a government agency - U.S. Health and Human Services has a patent on medical marijuana.

The U.S. Patent Office issued patent #6630507 to the U.S.Health and Human Services filed on 2/2/2001. The patent lists the use of certain cannabinoids found within the cannabis sativa plant as useful in certain neurodegenerative diseases such as Alzheimer's, Parkinson's, and HIV dementia.
