CANADA’S NEW DRUG DRIVING RULES

As legalisation approaches, there appears to be a lot of misinformation surrounding the legal THC limit in one’s blood with respect to driving. The easiest way to think of this is zero tolerance as this recent Globe & Mail states (“you shouldn’t be driving with any cannabis in your body…”); however, there are three thresholds. Less than two nanograms
Is not an offence.
Two to five nanograms
Is not a criminal offence but may attract fines of up to $1,000.
Over 5 nanograms
Could be jail time of up to 10 years as well as fines. There is also a hybrid offence for over 0.08 blood alcohol and over 5 nanograms of THC and this is the most severe offence of the three offences for THC only.
Hybrid Offence
Punishment based on BAC and THC levels. Based on having a Blood Alcohol level over 0.05 and THC over 2.5 nanograms. Remember, there is basically no amount of cannabis consumed that results in under 2 nanograms so 2.5 is not far off and for many a BAC of 0.05 may be three or less drinks.
What does that really mean? According to this source (Click Here) there is really no amount of cannabis one could consume that would result in under two nanograms and five nanograms is also considered
