In the United States, there is already a robust recreational marijuana market in the eight states that have legalized its usage, most notably Colorado. However, many of the producers and distributors to this market are limited to producing and distributing within their respective states – it is illegal to transport marijuana across state lines. Furthermore, these producers cannot publicly list their companies on recognized stock exchanges since they are engaged in business activities that are still technically illegal at the federal level.
Despite taking an ambivalent enforcement approach at the federal level (which was most notably highlighted in a memo from former U.S. Attorney General James Cole called the ‘Cole Memo’), the current Trump administration, and more particularly current Attorney General Jeff Sessions, have publicly raised concerns about recreational marijuana usage. There has been no indication whatsoever that the Trump administration will seek to legalize recreational marijuana usage, and could in fact increase enforcement of medical marijuana use under federal laws.
