A couple of minor legal questions for you from our readers. Now that there is a legal recreational adult market for cannabis if someone purchases cannabis legally from the OCS could they carry that cannabis (properly contained) into a sports or concert venue for the purpose of lawful consumption after the event OR can security seize the product and perhaps even bar the person from entering the venue?

Good question. As long as we’re referring to recreational and not medical i think it is probably within the purview of the venue to prevent people from entering with cannabis, just in the same vein that you are often prohibited from entering with alcohol. To my knowledge though the issue has not been directly addressed yet.

Thank you clarifying that. Another question - what do you see is the largest legal challenge the new framework (Federal then Provincial) will face?

I think the impaired driving law will be the first to make it’s way to a major legal challenge. People are already lined up to fight it and simply looking for the right plaintiff to advance the case. On the provincial side, i would go with a constitutional challenge in the provinces that have banned home-growing outright.
