even more important in order to prove that you have achieved due diligence. Remember the old saying; “If it is not written down, it doesn’t
count.” Legal experts say that you cannot prove due diligence unless
you have the proper documentation.
As an employer, it makes good business sense to take the steps necessary in order to protect your workers and supervisors. By doing so, you
will be protecting your customers, family and business at the same time.
“supervisor” means a person who has charge of a workplace or
authority over a worker
Definitions from the OHS Act
“workplace violence” means,
“worker” means a person who performs work or supplies services for
monetary compensation but does not include an inmate of a correctional institution or like institution or facility who participates inside
the institution or facility in a work project or rehabilitation program
“competent person” means a person who,
(a) is qualified because of knowledge, training and experience
to organize the work and its performance,
(b) is familiar with this Act and the regulations that apply to the
work, and
(c) has knowledge of any potential or actual danger to health or
safety in the workplace;
“employer” means a person who employs one or more workers or
contracts for the services of one or more workers and includes a contractor or subcontractor who performs work or supplies services and a
contractor or subcontractor who undertakes with an owner, constructor, contractor or subcontractor to perform work or supply services
(a) the exercise of physical force by a person against a worker,
in a workplace, that causes or could cause physical injury to
the worker,
(b) an attempt to exercise physical force against a worker, in a
workplace, that could cause physical injury to the worker,
(c) a statement or behaviour that it is reasonable for a worker
to interpret as a threat to exercise physical force against the
worker, in a workplace, that could cause physical injury to
the worker.
