BRINGING EMPLOYEES BACK TO WORK
[ Note : The following information was compiled from guidance provided by Jackson-Lewis . However , it should not be construed as legal advice nor be considered a substitute for consulting an attorney with any specific legal question .]
1 . Now that dental practices are no longer limited to treating only emergency / urgent cases , what do I do if my employees are reluctant to return to work ?
2 . What if my employee claims a “ protection ” that ’ s not in the list from the CARES Act ? Are there other valid reasons why they might not be required to return to work , or would only return under certain conditions ?
3 . If an employee is reluctant to return to work and doesn ’ t fit any of the exceptions noted above , can that employee be disciplined ?
4 . After thoroughly assessing and documenting the employee ’ s reasons for not returning to work and determining the employer has no obligation to accommodate the employee as per the above , if an employer wishes to notify the Office of Unemployment Compensation that the employee has refused to return to work , how is that done ?
REOPENING : IT ’ S AS IF EVERY EMPLOYEE IS A NEW EMPLOYEE NOW
You can expect a wide range of “ new normals ” that will impact every aspect of the practice — procedurally , clinically and administratively . This will require a lot of training and a formal , well-thought-out plan for onboarding everyone — both new and returning staff — before you reopen . COVID-19 RELIEF FROM CHARGES FOR EMPLOYERS
An important update from the Office of Unemployment Compensation :
“ We are aware that employers ’ UC-640 charge statements are indicating that employers are being charged for all benefits . All charges which are a result of separation due to COVID-19 will receive credits , retroactively . You do NOT need to contact us and you do NOT need to send in any paper work . The department is working on the programming needed to grant automatic relief from charges .” Benefit charging will resume after the governor declares an end to the pandemic disaster . The UC-640 charge statement shows you all the individuals you would otherwise be charged for if they continue filing benefits after the disaster is ended . Read the full update here .
